1. Agreement to these terms
This website is operated by J & R LANDIS ENTERPRISES, LLC. By accessing the site, submitting the request form or booking a service, you agree to these Terms of Use. If you do not agree, please do not use the site.
These terms apply alongside our Privacy Policy, Cookie Policy and Disclaimer, which are incorporated by reference.
2. Who may use the site
You must be at least 18 years old and legally able to enter a contract. If you request work on a property, you confirm that you own it or are authorised by the owner to arrange that work. You agree that the information you give us is accurate and that you will keep it up to date.
3. What this website is
The site describes our services and lets you request contact. Submitting the form does not create a booking and does not form a contract for work. A contract is formed only when we have inspected or discussed the job, issued a written estimate, and you have accepted it.
4. Estimates and pricing
- Prices shown on this site are starting points for a standard single-system residential property. They are not offers and not binding quotes.
- A firm price is given in writing after we have assessed the system — its size, condition, accessibility and the number of supply and return runs.
- A written estimate is valid for 30 days unless it says otherwise.
- If we discover additional work once panels are open — for example a damaged duct run or contamination behind a wall — we will stop, explain it and obtain your approval before continuing. You are never charged for unapproved work.
- Estimates assume safe, reasonable access to the equipment. Where access requires additional equipment or time, we will tell you before any extra charge applies.
5. Scheduling, access and cancellation
- Appointment windows are estimates. Traffic, weather and emergency call-outs can move them; we will contact you if a technician is running late.
- An adult aged 18 or over must be present at the property for the duration of the visit.
- You agree to provide safe access to the equipment, including clearing stored items from around the air handler, furnace or attic hatch.
- Cancellation. You may cancel or reschedule at no charge with at least 24 hours' notice. Cancellations inside 24 hours, or a locked property with nobody home on arrival, may incur a trip fee reflecting the reserved slot and travel.
- We may cancel or reschedule where conditions are unsafe — for example live electrical faults, a suspected gas leak, hazardous materials, or structural risk. In that case you pay only for work already completed.
6. Payment
- Payment is due on completion unless we have agreed different terms in writing.
- We accept the payment methods listed on your invoice. We never ask for payment details through this website's contact form.
- Overdue balances may accrue interest at the lesser of 1.5% per month or the maximum permitted by Wyoming law, together with reasonable collection costs.
- Disputed charges should be raised in writing within 14 days of the invoice date so we can investigate while the work is fresh.
7. Our workmanship guarantee
We guarantee our workmanship for 12 months from the date of service. If a fault results from how we performed the work, we will return and put it right at no charge. This guarantee does not cover:
- new contamination from ordinary use, renovation, pets, smoking, flooding or fire after our visit;
- pre-existing defects we identified in writing and you declined to have repaired;
- failure of equipment we did not install or service;
- work altered, opened or serviced by anyone else after us.
Equipment and parts we supply carry only the manufacturer's own warranty, which we will pass through to you.
8. Acceptable use of the website
You agree not to:
- submit false, misleading or another person's details through our forms;
- use the site to send spam, advertising or automated bulk submissions;
- attempt to gain unauthorised access to the site, its server or any connected system;
- probe, scan or test the vulnerability of the site, or breach its security or authentication measures;
- use scrapers, bots or similar tools to harvest content or contact details;
- copy, republish or resell site content for commercial purposes without our written permission;
- use the site in any way that breaks the law or infringes anyone's rights.
We may suspend or block access where we reasonably believe these rules have been broken.
9. Intellectual property
The site's text, layout, graphics, logos and the J & R Landis Enterprises name are owned by us or used under licence, and are protected by United States copyright and trademark law. You may view and print pages for your own non-commercial use. Any other use — copying, redistributing, framing or creating derivative works — requires our prior written consent.
10. Reviews and submissions
If you send us a review, photograph or suggestion, you grant us a non-exclusive, royalty-free, worldwide licence to use it in connection with our business, including on this site and in marketing. You confirm the material is yours to give and does not infringe anyone's rights. We are not obliged to publish anything, and may remove content that is unlawful, abusive or misleading.
11. Third-party links
Links to other websites are provided for convenience only. We do not control them, do not endorse them by linking, and are not responsible for their content, products or privacy practices.
12. Disclaimer of warranties
The website and its content are provided "as is" and "as available". To the fullest extent permitted by law, we disclaim all warranties, express or implied, including implied warranties of merchantability, fitness for a particular purpose and non-infringement. We do not warrant that the site will be uninterrupted, error-free or free of harmful components, or that any information on it is complete or current. This paragraph concerns the website; it does not limit the workmanship guarantee in section 7 or any warranty that applies to services we actually perform.
13. Limitation of liability
To the fullest extent permitted by law, neither we nor our members, employees or contractors are liable for indirect, incidental, special, consequential, exemplary or punitive damages, or for lost profits, lost data or business interruption, arising from your use of this website — even if we were advised such damages were possible.
Liability arising from services we actually perform is governed by the written estimate and our workmanship guarantee, and is limited to the amount you paid for the service in question.
Nothing in these terms excludes or limits liability that cannot lawfully be excluded, including liability for death or personal injury caused by negligence, or for fraud or fraudulent misrepresentation. Some jurisdictions do not allow certain limitations, so parts of this section may not apply to you.
14. Indemnification
You agree to indemnify and hold harmless J & R LANDIS ENTERPRISES, LLC, its members, employees and contractors from claims, losses and reasonable legal costs arising from your misuse of the website, your breach of these terms, or your violation of any law or third-party right.
15. Governing law and disputes
These terms are governed by the laws of the State of Wyoming, without regard to conflict-of-law rules. You and we agree to the exclusive jurisdiction of the state and federal courts located in Fremont County, Wyoming.
Before starting formal proceedings, please contact us so we can try to resolve the matter directly — most issues are settled with a phone call. Nothing here prevents either party from seeking relief in a small claims court.
16. Changes to these terms
We may update these terms as our services or the law change. The revision date at the top of this page shows the current version, and continued use of the site after an update means you accept it. The terms in force when you accepted a written estimate continue to govern that particular job.
17. General
- Severability. If any provision is held unenforceable, the rest remains in force.
- No waiver. If we do not enforce a provision, we have not waived our right to do so later.
- Assignment. You may not assign your rights under these terms without our consent; we may assign ours in connection with a sale or reorganisation of the business.
- Entire agreement. These terms, together with any written estimate you accept, are the entire agreement between us on their subject matter.
